These Terms and Conditions of Use (the “T’s and C’s”) were last updated on September 16, 2011.

Welcome to the RDP online ordering system, and extension of the Web site of RDP Foodservice. As used in these Terms and Conditions, the term “Web site” refers to the Website located at www.rdpfoodservice.com as well as our online ordering system. RDP Foodservice is not responsible for any third-party site to which the web site links.

You agree that your use of the Web site is subject to the following Terms and Conditions. These Terms and Conditions may be modified at any time and from time to time; the date of the most recent changes or revisions will appear on this page. Continued access to the Web site by you will constitute your acceptance of any changes or revisions to this Agreement. If you do not agree to the Terms and Conditions, please do not use this Web site.

Placing orders

Instructions and details on ordering online are available directly on the site. It is very important to pay close attention to this information as it will always be the most recent and most accurate.

Orders must be placed before 4:00 pm EST for next day delivery. Orders placed after 4pm will only have the option to ship on delivery days scheduled in the future which could be the following week.

You may place orders for up to 3 of your next scheduled delivery days when ordering online. Please be very careful to select the correct day as RDP will not be held responsible for orders placed for the wrong delivery day.

Saturdays and Sundays are not available as delivery days under normal circumstances.

Changes in the operating schedule of the online ordering system can sometimes occue. This is most often due to regular maintenance or due to a holiday. These changes will be announced with advanced notice via notifications on the site itself and by other means.

Item availability

The items that are available to your on the site are the items that you purchase most often and therefore are a part of your “order guide”.

Items that are blue in color are items that have been given special order status and must be pre-ordered through your sales representatives or our customer service department.

Items that are not available at the time or order processing may result in a substitution. Visible substitutions may not exist for every item. Substitutions are used only in specific situations and the decision to use them is left to management’s discretion.

Passwords

RDP Foodservice reserves the sole right to assign passwords to its online ordering system users. Please guard this personal information, as you are responsible to keep your password confidential. If a customer loses their password, they are responsible for contacting RDP Foodservice to have the password reset. Likewise, if customer has a need to change a password due to employee changes or termination, customer is responsible for contacting RDP Foodservice to have the password reset.

Quantity ordered

It is solely the customers’ responsibility to check quantity of items ordered before submitting order to RDP Foodservice. Once an order is placed, customer is financially responsible for entire cost of order. Please review your order for accuracy before submitting.

Credit Hold policy

If customers account is flagged for outstanding invoices, non-payment, insufficient funds, or returned checks, customers account will be flagged placed on “credit hold”. Customer will not be able to place an order until matter is resolved. Outstanding credit issues can be corrected by contacting your sales consultant or RDP’s credit department.

Product catalog

Customer will have access to RDP Foodservice product catalog. Please note that once you add a “new item” (“new item” indicating a product that does not currently appear on your order guide) to your order, this item will appear in your order guide. If product is not recorded in a 90-day timeframe, item will automatically be removed from order guide after that 90-day timeframe.

scheduled maintenance

RDP Foodservice periodically schedules system downtime for maintenance and other purposes. Unplanned outages also may occur. RDP Foodservice shall have no liability for the resulting unavailability of the Web site or for any loss of data or transactions caused by planned or unplanned system outages, or any outages or web hosts providers or the Internet infrastructures and networks external to the Web site.

All materials published on the Website are protected by copyright laws, and may not be reproduced, republished, distributed, transmitted, resold, displayed, broadcast, or otherwise exploited in any manner without the express written permission by RDP Foodservice.
